These Terms & Conditions (“Terms”) govern your access to and use of shop.mitobi.ca, including all purchases of products and services made through our website or directly through Mitobi.
By accessing our website, creating an account, requesting a quotation, placing an order, or purchasing any product or service from Mitobi, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or purchase products or services from us.
1. DEFINITIONS
For the purpose of these Terms & Conditions:
“Mitobi” means Mitobi, the owner and operator of shop.mitobi.ca.
“Website” means shop.mitobi.ca and all pages operated under this domain.
“Customer” means any individual or business purchasing products or services from Mitobi.
“Products” include, but are not limited to:
- Consumer electronics
- Bluetooth devices
- Smart trackers
- Smart glasses

- Fire safety products
- Networking equipment
- Computer accessories

“Special Order” means any item ordered specifically at the request of a customer and not normally stocked by Mitobi.
“Business Day” means Monday through Friday excluding statutory holidays in Manitoba.
2. ELIGIBILITY
By using this Website or placing an order, you confirm that:
- You are legally capable of entering into a binding agreement, or you have the permission of a parent or legal guardian.
- All information you provide is accurate and complete.
- You will keep your account information up to date.

- colours displayed on your screen exactly match the actual product;
- packaging shown on the Website will always match current manufacturer packaging;
- manufacturers will not change specifications without prior notice.
Manufacturers may update specifications, packaging, firmware, accessories, or product features at any time.
Mitobi reserves the right to discontinue products without notice.
4. PRODUCT AVAILABILITY
Product availability displayed on our Website is intended as a guide only.
Although we strive to keep inventory information current, stock levels may change due to:

5. PRICING
Unless otherwise stated:
- All prices are shown in Canadian Dollars (CAD).
- Applicable GST and PST will be added during checkout where required by law.
- Prices are subject to change without notice.
Although we take reasonable care to ensure pricing accuracy, errors may occasionally occur.
Where a pricing error is discovered before an order is fulfilled, Mitobi reserves the right to:
- correct the price;
- contact the customer for approval;
- or cancel the order and issue a refund if payment has already been received.
6. PAYMENT METHODS
At this time, Mitobi does not process online credit card payments through the Website.
Accepted payment methods may include:
- Interac e-Transfer
- Credit Card at Pickup
- Credit Card upon Local Delivery (where available)
- Debit Card at Pickup
- Cash at Pickup (subject to availability)
- Other payment methods approved by Mitobi
Payment instructions will be provided once an order has been confirmed.
Mitobi reserves the right to refuse any payment method at its discretion.
Ownership of products remains with Mitobi until full payment has been received.
7. REQUESTS FOR QUOTATIONS (RFQs)
Customers may request quotations for products or services.
Submitting a quotation request does not create a contract between the customer and Mitobi.
Mitobi reserves the right to decline quotation requests where:
- requested products cannot reasonably be sourced;
- supplier availability is uncertain;
- pricing cannot be confirmed;
- the requested products or services fall outside our business operations.
Unless otherwise stated, quotations are valid for 30 days from the date issued.
Prices may change after the quotation expiry date.
8. SPECIAL ORDERS
Certain products are ordered specifically for individual customers.
Special-order products generally require a deposit before Mitobi places the order with the supplier.
Once a special-order item has been ordered from our supplier, the order cannot normally be cancelled, returned, or refunded, except where:
- the wrong product was supplied;
- the product is defective upon arrival;
- or Mitobi agrees otherwise in writing.
Estimated delivery dates for special-order products are estimates only and may change due to supplier or transportation delays.
9. ORDER ACCEPTANCE
Placing an order through our Website does not automatically mean the order has been accepted.
Orders become accepted only when:
- product availability has been confirmed;
- pricing has been confirmed;
- payment arrangements have been agreed upon where applicable;
- and Mitobi has communicated acceptance of the order.
Mitobi reserves the right to refuse or cancel any order where:
- products become unavailable;
- incorrect pricing has occurred;
- fraud is suspected;
- payment cannot be verified;
- the customer has provided inaccurate information;
- or fulfilling the order is otherwise not reasonably possible.
10. ORDER CANCELLATIONS
Customers may request cancellation of an order before it has been processed.
Orders for regularly stocked products may generally be cancelled without penalty if:
- payment has not yet been made; and
- the order has not yet been processed or dispatched.
Special-order products cannot normally be cancelled once Mitobi has confirmed the order with its supplier.
Where a deposit has been paid for a special-order product, that deposit may become non-refundable once the supplier has accepted the order.
Mitobi reserves the right to cancel an order where circumstances beyond our control prevent us from fulfilling it. In such cases, any payments received for unfulfilled products will be refunded.
11. SHIPPING & DELIVERY
Mitobi offers local delivery and shipping services throughout the Pembina Valley region and other locations where practical.
Delivery availability, estimated delivery times, and shipping costs depend on the product, destination, order size, supplier availability, and the selected delivery method.
Delivery dates provided by Mitobi are estimates only and are not guaranteed.
Mitobi shall not be liable for delays caused by:
- supplier shortages;
- courier delays;
- customs or border inspections;
- severe weather conditions;
- transportation disruptions;
- labour disputes;
- government actions;
- Force Majeure events; or
- any other circumstances beyond our reasonable control.
Customers will be notified as soon as reasonably possible if significant delivery delays occur.
12. SHIPPING CHARGES
Mitobi is committed to providing fair and reasonable delivery options.
Local Delivery
Delivery within:
- Morden
- Winkler
is generally provided free of charge, subject to order value, product type, and delivery scheduling.
Pembina Valley Deliveries
Deliveries outside Morden and Winkler but within the Pembina Valley may incur a delivery charge.
Delivery charges are not fixed.
Instead, they are determined based on:
- destination;
- package size;
- package weight;
- delivery urgency;
- transportation method;
- and other relevant factors.
Mitobi will communicate the delivery cost to the customer before dispatch, and delivery will proceed only after the customer has approved the shipping cost.
13. PICKUP ORDERS
Customers may collect orders from either of our pickup locations.

Pickup is available during Mitobi’s posted business hours or by appointment where applicable.
Customers may be required to provide:
- proof of identity;
- order confirmation;
- or proof of payment before products are released.
14. HOLDING OF PICKUP ORDERS
Orders awaiting pickup will be held according to the following guidelines:
Unpaid Orders
Products that have not been paid for will normally be held for 48 hours after notification that the order is ready for pickup.
If payment has not been received within this period, Mitobi may cancel the order without further notice.
Paid Orders
Products that have been fully paid for will be held for a reasonable period.
Customers who require additional time should contact Mitobi to make alternative arrangements.
Mitobi reserves the right to contact customers regarding long-uncollected orders and may apply reasonable storage arrangements where permitted by law.
15. DELIVERY CONFIRMATION
Where products are delivered directly to a customer, Mitobi will make reasonable efforts to confirm:
- the delivery address;
- the delivery recipient;
- and the agreed delivery location.
Delivery may include:
- signature confirmation;
- delivery photographs;
- written confirmation;
- or electronic confirmation where appropriate.
Once delivery has been completed in accordance with the customer’s instructions, responsibility for the product transfers to the customer.
16. RISK OF LOSS
Risk of loss or damage passes to the customer when:
- the customer collects the product;
- an authorized representative collects the product;
- or delivery has been completed to the agreed delivery location.
Mitobi is not responsible for:
- theft;
- loss;
- weather damage;
- vandalism;
- or damage occurring after confirmed delivery.
Customers are encouraged to inspect delivered products promptly.
17. PRODUCT INSPECTION
Customers should inspect products as soon as reasonably possible after receiving them.
Any visible damage, missing accessories, incorrect items, or shipping concerns should be reported to Mitobi within 48 hours of receiving the order.
Failure to report visible issues within this period may affect the outcome of a claim.
18. RETURNS
Mitobi wants every customer to be satisfied with their purchase.
Eligible products may be returned within seven (7) calendar days from the date of delivery or pickup.
To qualify for a return:
- the customer must provide proof of purchase;
- the product must be returned within seven days;
- the product must pass Mitobi’s inspection;
- the product must not have been intentionally damaged or altered.
Mitobi reserves the right to decline returns that do not satisfy these requirements.
19. OPENED PRODUCTS
Certain products may still qualify for return after being opened.
Eligibility depends on:
- product condition;
- completeness of accessories;
- packaging;
- manufacturer requirements;
- and inspection results.
Opened products that show evidence of:
- misuse;
- installation damage;
- missing accessories;
- excessive wear;
- or customer-caused damage
may not qualify for refund or exchange.
Mitobi’s inspection decision shall determine return eligibility.
20. NON-RETURNABLE PRODUCTS
The following items are generally not eligible for return:
- Special-order products;
- Custom-configured equipment;
- Clearance or final-sale items (where identified);
- Products damaged by misuse;
- Products modified by the customer;
- Products with missing major components;
- Products damaged through improper installation;
- Software licenses;
- Digital products;
- Products that cannot reasonably be resold due to their condition.
Exceptions may apply where required by law.
21. REFUNDS
Approved refunds will normally be processed within 48 hours after the returned product has successfully passed inspection.
Refunds will generally be issued using the original payment method whenever practical.
Shipping charges are generally non-refundable unless the return results from:
- Mitobi’s error;
- a defective product;
- or an incorrect shipment.
22. WARRANTY
Mitobi provides warranty support for eligible products sold through our Website.
Warranty coverage varies depending on:
- manufacturer policies;
- product type;
- and Mitobi’s warranty program.
Warranty claims are subject to inspection.
Mitobi may choose to:
- repair the product;
- replace the product;

23. WARRANTY EXCLUSIONS
Warranty coverage does not normally include damage resulting from:

- unauthorized repairs;

- water damage;
- moisture;
- flooding;
- lightning;
- electrical surges;
- fire;
- environmental conditions;
- extreme temperatures;
- normal wear and tear;
- failure to follow operating instructions.
Warranty coverage may also be void where serial numbers or manufacturer labels have been removed or altered.
24. INSTALLATION SERVICES
Mitobi offers professional installation services for selected products.
Installation services are separate from the purchase of products unless specifically stated otherwise.
Customers purchasing products without installation are responsible for ensuring that installation is completed correctly and safely.
Improper installation performed by the customer or a third party may affect warranty eligibility.
Mitobi is not responsible for damage resulting from improper installation performed by anyone other than Mitobi or its authorized representatives.
25. SECURITY PRODUCT DISCLAIMER
Mitobi supplies electronic security products designed to reduce security risks and improve monitoring capabilities.
However, no security product or system can guarantee:
- prevention of theft;
- prevention of burglary;
- prevention of vandalism;
- prevention of fire;
- prevention of unauthorized access;
- prevention of property damage;
- or protection against every possible security incident.
Customers acknowledge that:
- security systems reduce risk but cannot eliminate it;
- proper maintenance is essential;
- testing should be performed regularly;
- and appropriate insurance coverage should always be maintained.
Mitobi shall not be liable for losses resulting from criminal acts, emergencies, equipment limitations, power failures, communication failures, internet outages, or circumstances beyond the intended capability of the products supplied.
26. CUSTOMER ACCOUNTS
Customers may create an account on shop.mitobi.ca to facilitate purchases, manage orders, and access certain features.
Customers are responsible for:
- maintaining the confidentiality of their login credentials;
- ensuring their password remains secure;
- updating their account information when it changes;
- all activities carried out using their account.
Mitobi is not responsible for unauthorized access resulting from:
- passwords shared by the customer;
- weak passwords;
- customer negligence;

Certain products sold by Mitobi may require:
- mobile applications;
- cloud services;
- internet access;
- firmware updates;
- operating system compatibility;
- third-party software.
Mitobi does not control these third-party services and is not responsible for interruptions, changes, discontinued services, or compatibility issues arising from software or applications provided by third parties.
31. ACCEPTABLE USE
Customers agree not to use products purchased from Mitobi:
- for unlawful purposes;
- to violate privacy rights;
- to interfere with computer systems without authorization;
- for fraudulent activities;
- in violation of applicable Canadian laws or regulations.
Customers purchasing surveillance equipment are solely responsible for ensuring that installation and operation comply with all applicable privacy laws and legal requirements.
32. WEBSITE AVAILABILITY
Mitobi strives to keep its Website available at all times.
However, we do not guarantee uninterrupted access.
The Website may be temporarily unavailable due to:
- maintenance;
- upgrades;

Mitobi shall not be liable for losses arising from temporary website interruptions.
33. LIMITATION OF LIABILITY

35. FORCE MAJEURE
Mitobi shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control.
These circumstances include, but are not limited to:
- severe weather;
- snowstorms;
- flooding;
- fires;
- natural disasters;
- pandemics;
- public health emergencies;
- supplier shortages;
- transportation disruptions;
- courier delays;
- customs inspections;
- border delays;
- labour disputes;
- government actions;
- power outages;
- internet failures;
- telecommunications failures;
- cyber incidents;
- or any other event beyond Mitobi’s reasonable control.
Mitobi will make reasonable efforts to notify customers of significant delays and resume normal operations as soon as reasonably possible.
36. GOVERNING LAW
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Province of Manitoba and the applicable federal laws of Canada.
Any dispute arising from these Terms or the use of shop.mitobi.ca shall be subject to the jurisdiction of the courts of Manitoba, unless otherwise required by applicable law.
37. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.
38. ENTIRE AGREEMENT
These Terms & Conditions, together with any policies referenced herein constitute the entire agreement between the customer and Mitobi concerning the use of the Website and the purchase of products and services.
For commercial projects, installation contracts, or signed quotations, the terms of the signed agreement shall prevail where there is a conflict with these Website Terms.
39. CHANGES TO THESE TERMS
Mitobi reserves the right to modify these Terms & Conditions at any time.
Updated versions will be posted on shop.mitobi.ca with a revised “Last Updated” date.
Continued use of the Website after changes have been posted constitutes acceptance of the revised Terms.
